This Privacy Policy describes how Elatre Solutions Pvt Ltd, doing business as Elatre ("Elatre," "we," "us," or "our"), collects, uses, discloses, and safeguards personal information when you visit elatre.com (the "Site"), communicate with us, or engage our services (the "Services"). For purposes of applicable data protection laws, Elatre Solutions Pvt Ltd is the data controller (and, under Indian law, the data fiduciary) of personal information collected through the Site.

PLEASE READ THIS PRIVACY POLICY CAREFULLY. BY ACCESSING OR USING THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH OUR POLICIES AND PRACTICES, PLEASE DO NOT USE THE SITE.

1. Information We Collect

(a) Information You Provide to Us. We collect information you voluntarily provide when you request a proposal, plan, or audit; book a strategy call; complete a contact form; subscribe to communications; apply for employment; or become a client. This may include: name; email address; telephone number; company name and job title; country and region; the contents of your messages; billing and transaction information; and any files or materials you choose to submit.

(b) Information Collected Automatically. When you visit the Site, we and our service providers automatically collect certain information about your device and usage, including: Internet Protocol (IP) address; browser type and version; operating system; device identifiers; referring URLs; pages viewed, links clicked, and time spent on pages; and approximate geographic location inferred from IP address. This information is collected through cookies, pixels, log files, and similar technologies, as described in Section 3.

(c) Information from Other Sources. We may receive information about you from third parties, including advertising platforms (such as Google and Meta), analytics providers, scheduling and payment vendors, and publicly available business sources, and we may combine it with information we collect directly.

(d) Categories of Personal Information. The information described above corresponds to the following categories under the California Consumer Privacy Act, as amended ("CCPA"): identifiers; customer records information; commercial information; internet or other electronic network activity information; geolocation data (approximate only); professional or employment-related information; and inferences drawn from the foregoing. We do not collect biometric information, precise geolocation, or, except where you volunteer it, sensitive personal information, and we ask that you not submit sensitive personal information through the Site.

2. How We Use Personal Information

We use personal information for the following business and commercial purposes: to respond to your inquiries and provide requested proposals, plans, and audits; to provide, administer, personalize, and bill for the Services; to operate, maintain, secure, and improve the Site; to perform analytics and measure the effectiveness of our marketing; to send administrative and transactional communications; to send marketing communications where permitted by law, subject to your right to opt out; to detect, prevent, and address fraud, abuse, and security incidents; to comply with legal obligations and enforce our agreements; and to establish, exercise, or defend legal claims.

3. Cookies and Tracking Technologies

We use cookies, web beacons, pixels, and similar technologies. These include: (a) strictly necessary cookies, required for the Site to function; (b) analytics cookies (such as Google Analytics), which help us understand how visitors interact with the Site; and (c) advertising cookies (such as Google Ads and Meta pixels), used for campaign measurement and remarketing.

You can manage or delete cookies through your browser settings and can opt out of personalized advertising through Google's Ads Settings, Meta's ad preferences, and industry tools such as the Digital Advertising Alliance opt-out page at optout.aboutads.info. Where required by law, we honor opt-out preference signals such as the Global Privacy Control (GPC) as a valid request to opt out of targeted advertising for the browser or device transmitting the signal. Except as described in the foregoing sentence, the Site does not currently respond to "Do Not Track" browser signals, for which no industry standard has been adopted.

4. How We Disclose Personal Information

We do not sell personal information for monetary consideration. We disclose personal information to the following categories of recipients for the purposes described above: (a) service providers and processors, including hosting, cloud infrastructure, analytics, email delivery, CRM, scheduling, and payment processing vendors, bound by contractual confidentiality and data protection obligations; (b) advertising partners, in connection with campaign measurement and remarketing, which may constitute "sharing" for cross-context behavioral advertising under the CCPA, and you may opt out as described in Sections 3 and 9; (c) professional advisors, such as auditors, accountants, and legal counsel; (d) government authorities and other parties, where required by law, subpoena, or legal process, or where necessary to enforce our agreements or protect the rights, property, or safety of Elatre, our clients, or others; and (e) successors in interest, in connection with a merger, acquisition, financing, reorganization, or sale of all or a portion of our assets.

5. International Data Transfers

We are headquartered in India and serve clients in the United States, Canada, the United Kingdom, and the European Union. Personal information may be transferred to, stored in, and processed in India, the United States, and other countries where we or our service providers operate, which may have data protection laws different from those of your jurisdiction. Where required, we implement appropriate safeguards for such transfers, including contractual commitments, and we transfer personal data only to jurisdictions not restricted under applicable Indian law.

6. Data Retention

We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, tax, and reporting requirements, to resolve disputes, and to enforce our agreements. As a general matter, inquiry records are retained for up to twenty-four (24) months following our last interaction with you, and client records are retained for the duration of the engagement plus the period required by applicable law. When personal information is no longer required, we delete or de-identify it.

7. Data Security

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, including access controls, encryption of data in transit, and vendor due diligence. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. In the event of a breach of security affecting your personal information, we will notify you and the appropriate authorities as required by applicable law.

8. Your Choices

You may opt out of marketing emails at any time by using the unsubscribe link contained in each message or by emailing support@elatre.com. We process opt-out requests promptly in accordance with the U.S. CAN-SPAM Act and other applicable laws. Please note that you may continue to receive transactional and service-related communications, which are not marketing in nature.

9. Your Privacy Rights

(a) United States State Privacy Rights. If you are a resident of California, Virginia, Colorado, Connecticut, Texas, Oregon, Montana, or another U.S. state with a comprehensive privacy law in effect, you may have some or all of the following rights, subject to the conditions and exceptions of your state's law: the right to know and access the personal information we have collected about you, including the categories collected, the sources, the purposes, and the categories of third parties to whom it was disclosed; the right to obtain a portable copy of your personal information; the right to correct inaccurate personal information; the right to delete personal information, subject to statutory exceptions; the right to opt out of the sale of personal information, the sharing or processing of personal information for targeted advertising, and certain profiling (we do not sell personal information for money; to opt out of advertising-related sharing, use the cookie and GPC controls described in Section 3 or contact us); the right to limit the use of sensitive personal information (we do not use sensitive personal information for purposes requiring such a limitation); and the right to non-discrimination for exercising your rights. Residents of Virginia and certain other states also have the right to appeal a refusal to act on a rights request by replying to our decision email with the subject line "Privacy Appeal"; if your appeal is denied, you may contact your state Attorney General.

(b) European Economic Area and United Kingdom. If you are located in the EEA or the UK, we process your personal data on the following legal bases: performance of a contract or pre-contractual steps taken at your request; your consent, which you may withdraw at any time without affecting prior processing; our legitimate interests in operating, securing, and promoting our business, balanced against your interests and rights; and compliance with legal obligations. You have the rights of access, rectification, erasure, restriction of processing, data portability, and objection (including to direct marketing), and the right to lodge a complaint with your local supervisory authority.

(c) India. If you are located in India, in accordance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and rules thereunder, you have the right to access a summary of your personal data and the processing activities undertaken; to correction, completion, and updating of your personal data; to erasure of personal data no longer necessary for the stated purpose; to grievance redressal; and to nominate an individual to exercise your rights in the event of death or incapacity. You may withdraw consent at any time, with effect for future processing.

(d) Exercising Your Rights. To exercise any right described above, email support@elatre.com with the subject line "Privacy Request," describing your request and the jurisdiction in which you reside. We will verify your identity using the information associated with your interaction with us and may request additional information where necessary for verification. You may designate an authorized agent to act on your behalf where permitted by law; we will require proof of the agent's authority. We will acknowledge requests within ten (10) business days and respond within the time period required by applicable law. We will not discriminate against you for exercising your privacy rights.

10. Children's Privacy

The Site and Services are directed to business users and are not intended for children. We do not knowingly collect personal information from children under the age of thirteen (13), and we do not knowingly collect or solicit personal information from anyone under eighteen (18). If we learn that we have collected personal information from a child, we will delete it promptly. If you believe a child has provided us with personal information, please contact support@elatre.com.

11. Third-Party Sites and Intellectual Property Inquiries

The Site may contain links to websites and services operated by third parties, whose privacy practices are governed by their own policies, which we encourage you to review. Third-party names, logos, and materials displayed on the Site are used for identification and demonstration purposes only, as described in our Terms and Conditions; intellectual property inquiries should be directed to support@elatre.com and will be reviewed and answered within seven (7) to ten (10) business days under the procedure set forth in the Terms and Conditions.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, or legal requirements. The updated version will be indicated by a revised "Effective Date" and will be effective as soon as it is accessible. If we make material changes, we will provide notice on the Site or, where required by law, directly to you. Your continued use of the Site after the revised Privacy Policy becomes effective constitutes acceptance.
