Cancellation and Refund Policy

This Cancellation and Refund Policy (this "Policy") governs cancellations, renewals, free trials, and refunds for all services provided by Elatre Solutions Pvt Ltd, doing business as Elatre ("Elatre," "we," "us," or "our"). This Policy is incorporated into and forms part of our Terms and Conditions. By purchasing, subscribing to, or renewing any Elatre service, you acknowledge that you have read, understood, and agree to this Policy.
PLEASE READ THIS POLICY CAREFULLY BEFORE PURCHASING. EXCEPT AS EXPRESSLY PROVIDED IN SECTION 6 BELOW, ALL FEES PAID TO ELATRE ARE FINAL AND NON-REFUNDABLE.
1. No-Refund Policy
Our services consist of professional time, strategy, research, creative production, and engineering work that is allocated and commenced shortly after an engagement begins and cannot be recovered or resold. Accordingly, to the fullest extent permitted by applicable law, all fees are non-refundable, including without limitation: (a) setup, onboarding, and audit fees; (b) deposits, advances, and prepayments; (c) monthly, quarterly, and annual retainer and subscription fees; (d) fees for completed or in-progress project milestones; (e) consulting, strategy, and training fees; and (f) fees paid under discounted, bundled, or promotional pricing.
Without limiting the foregoing, no refund, credit, or proration will be issued for: partially used billing periods; services purchased but not used; dissatisfaction with creative direction or subjective preferences; changes in your business circumstances, budget, staffing, or strategy; or outcomes affected by third-party platforms, algorithms, or market conditions.
2. Subscription Services; Automatic Renewal
AUTOMATIC RENEWAL DISCLOSURE: SUBSCRIPTION AND RETAINER SERVICES RENEW AUTOMATICALLY AT THE END OF EACH BILLING CYCLE (MONTHLY, QUARTERLY, OR ANNUALLY, AS STATED IN YOUR ORDER) UNTIL CANCELLED. YOUR PAYMENT METHOD ON FILE WILL BE CHARGED, OR YOU WILL BE INVOICED, AT THE THEN-CURRENT RATE FOR EACH RENEWAL PERIOD UNLESS YOU CANCEL BEFORE THE RENEWAL DATE.
To avoid charges for an upcoming billing cycle, your cancellation request must be received before that cycle's renewal date. We recommend submitting cancellation requests at least seven (7) days in advance to allow for processing, but a request received at any time before the renewal date will be honored for the following cycle. Once a renewal payment has been processed or a billing cycle has commenced, the fees for that cycle are due in full and are non-refundable, and the services will continue through the end of the paid period.
3. Free Trials and Promotional Offers
If you enroll in a free trial, free plan period, or promotional offer that converts into a paid subscription: (a) the duration of the trial and the date and amount of the first charge are disclosed at the time of enrollment; (b) you must cancel before the end of the trial or promotional period to avoid being charged; (c) if you do not cancel in time, your enrollment converts automatically into a paid subscription at the rate disclosed at signup, and renews thereafter in accordance with Section 2; and (d) amounts charged upon or after conversion are non-refundable in accordance with Section 1. You are solely responsible for tracking your trial expiration date. We may, at our discretion and where required by applicable law, send a reminder before conversion, but the absence of a reminder does not affect your payment obligation.
4. Project-Based Engagements
For fixed-scope engagements, including website builds, software development, and one-time campaigns: (a) deposits and milestone prepayments are non-refundable; (b) if you cancel an engagement prior to completion, you remain responsible for all fees corresponding to work performed or in progress through the effective date of cancellation, and amounts previously paid will not be refunded; (c) deliverables, files, and access credentials are released only upon payment in full of all outstanding amounts; and (d) engagements paused at your request for more than sixty (60) consecutive days may be deemed cancelled, in which case this Section applies.
5. Advertising Spend and Third-Party Costs
Amounts paid or committed to third-party platforms and vendors, including advertising budgets (e.g., Google, Meta, TikTok, LinkedIn), software licenses, plugins, themes, stock assets, domain registrations, and hosting, are separate from Elatre's fees, are governed exclusively by the refund policies of the applicable third party, and are not refundable by Elatre under any circumstances.
6. Limited Exceptions
Notwithstanding Section 1, we will issue a refund or account credit in the following circumstances only: (a) a duplicate charge or verified billing error attributable to Elatre, which will be corrected in full promptly upon verification; and (b) any amount that applicable law requires us to refund and that cannot lawfully be excluded by agreement. Nothing in this Policy is intended to limit, exclude, or modify any non-waivable statutory rights you may have under the Consumer Protection Act, 2019 (India), or the mandatory consumer protection laws of your state or country of residence.
7. How to Cancel
All cancellation requests must be submitted in writing by email to support@elatre.com, sent from the email address of record on your account, and must include: (a) your business name; (b) the service(s) you wish to cancel; and (c) your requested effective date. Cancellation requests are not accepted by telephone, chat, social media, or verbal communication to team members.
We will acknowledge your request by email and confirm your final billing date, the end date of services, and any applicable handover steps within seven (7) to ten (10) business days of receipt. A cancellation is effective only upon our written confirmation. You remain responsible for all fees accrued through the end of the then-current paid billing period, and services will continue to be delivered through that date unless you instruct otherwise in writing.
8. Effect of Cancellation; Handover
Upon cancellation and payment in full of all outstanding amounts: (a) we will transfer to you the accounts, credentials, and deliverables that you own under the Terms and Conditions; (b) any licenses to Elatre's pre-existing materials continue as set forth in the Terms and Conditions; and (c) we may retain copies of records and work product as required for legal, tax, accounting, and archival purposes, subject to our confidentiality obligations and Privacy Policy.
9. Chargebacks and Payment Disputes
If you believe any charge was made in error, you agree to contact us at support@elatre.com and allow us a reasonable opportunity to investigate and resolve the matter before initiating a chargeback or payment dispute. Initiating a chargeback for charges that are valid under this Policy constitutes a material breach of the Terms and Conditions and entitles Elatre to immediately suspend services, recover the disputed amounts together with reasonable costs of collection, and decline future engagements.
10. Modifications to This Policy
We may modify this Policy from time to time. The version of this Policy in effect on the date of your purchase or most recent renewal governs that transaction. The current version will always be posted on the Site with its Effective Date. Continued use of the services following any modification constitutes acceptance of the modified Policy.
